Product Warranty Guidelines

Warranty coverage for Brocade products are described below. Additional support coverage can be purchased with your Brocade products. Please consult your local Brocade sales professional for annual support options and services fees.

The terms and conditions governing your warranty on Brocade products are located below. Such terms and conditions supersede all other terms, unless otherwise agreed by Brocade.

Warranty Start Date

"Start Date" as used in this policy means the date this product is shipped from the manufacturing facilities of Brocade.

Limited Hardware Warranty

Brocade Communications Systems, Inc. ("Brocade") provides a thirteen (13) month limited product hardware warranty to purchasers of Brocade products. Brocade warrants that the product hardware will be free from defects in materials and workmanship that result in a material deviation from the applicable published Brocade technical specifications ("Hardware System Failure"). Upon a Hardware System Failure, Brocade will repair or replace such product hardware within thirty (30) working days of its receipt of the failed hardware, if in advance of its receipt, such hardware received a Technical Support RMA number from Brocade. Further, the product hardware must be shipped, shipment pre-paid, to Brocade, and the RMA number must be clearly indicated on the shipping box and papers.

"Start Date" as used in this policy means the date this product is shipped from the manufacturing facilities of Brocade.

Limited Lifetime Hardware Warranty (5 Years)

For select products, Brocade provides a limited lifetime (five year) warranty as long as the original end-user continues to own and use the equipment. Brocade warrants that the hardware will be free from defects in material and workmanship that result in a material deviation from the applicable published Foundry technical specifications. This warranty excludes power supplies, fans, removable optics, and LEDs.

Products covered by this warranty are switches of the EdgeIron, FastIron Edge, FastIron WS, FastIron LS, FastIron GS, and FastIron Edge X/XE, and TurboIron Series.

In case of defects, such hardware must receive a Technical Support RMA number from Brocade. A replacement is shipped within thirty (30) working days after authorization from TAC and receipt of defective unit. The product hardware must be shipped, shipment pre-paid, to Brocade, and the RMA number must be clearly indicated on the shipping box and papers.

Limited Software Warranty

Brocade provides a ninety (90) day limited software warranty to licensees of Brocade software accompanying Brocade hardware. Brocade warrants that the media on which the software is delivered will be free of defects in material and workmanship for a period of ninety (90) days following delivery of the software to licensee. Brocade warrants that the software, when used in accordance with the terms of the Brocade software license, will operate substantially as set forth in the applicable Brocade Documentation for a period of ninety (90) days following delivery of the software to licensee.

Warranty Limitations

Brocade warranties as set forth herein ("Warranty") are contingent on proper use of the Brocade hardware and software ("Products") and do not apply if the Products have been modified without the written approval of Brocade, or if the Products' serial number label is removed, or if the Product has been damaged. The terms of the Warranty are limited to the remedies as set forth in this Warranty. THIS WARRANTY IS PROVIDED IN LIEU OF ALL OTHER RIGHTS, CONDITIONS AND WARRANTIES. BROCADE MAKES NO OTHER EXPRESS OR IMPLIED WARRANTY WITH RESPECT TO THE SOFTWARE, HARDWARE, PRODUCTS, DOCUMENTATION OR BROCADE SUPPORT, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. BROCADE DOES NOT WARRANT THAT ANY PRODUCTS WILL BE ERROR-FREE, OR THAT ANY DEFECTS THAT MAY EXIST IN ITS PRODUCTS CAN BE CORRECTED. IN NO EVENT SHALL BROCADE BE LIABLE FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS, LOST PROFITS OR ANY OTHER SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST DATA), HOWEVER CAUSED WHETHER OR NOT BROCADE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
